Please read these Terms carefully before placing an Order. These Terms apply to consumer purchases. Separate terms apply to business, trade and credit account customers. Nothing in these Terms affects your statutory rights.

Consumer Terms & Conditions

1. Definitions and Interpretation

These Terms and Conditions apply to all purchases of goods made by consumers from Monkey Tools, a trading division of Monkey Tools Ltd, whether through our website, by telephone or by any other distance selling method.

In these Terms:

"Business Day" means any day other than a Saturday, Sunday or public holiday in England on which banks are open for normal business.

"Consumer" means an individual acting for purposes wholly or mainly outside their trade, business, craft or profession.

"Contract" means the legally binding agreement between you and us for the sale of goods, formed in accordance with Section 3 of these Terms.

"Goods" means the products, accessories, spare parts or other items supplied by us under the Contract.

"Order" means your request to purchase Goods from us.

"Website" means www.monkeytools.co.uk.

"We", "Us" and "Our" mean Monkey Tools Ltd (Company Registration Number 15085721), trading as Monkey Tools.

"You" and "Your" mean the Consumer purchasing Goods from us.

References to legislation include any amendments, replacements or re-enactments of that legislation from time to time.

Headings are included for convenience only and do not affect the interpretation of these Terms.

Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 or any other applicable consumer protection legislation.

These Terms and Conditions apply to all sales made directly to Consumers.

Separate Terms and Conditions apply to business, trade or commercial customers. Trade and credit accounts are subject to application, approval and separate account terms supplied during the application process. Any agreed credit limit or payment period will be confirmed separately in writing.

If any provision of these Terms is found by a court to be unlawful or unenforceable, the remaining provisions shall continue in full force and effect.

3. Ordering, Contract Formation and Payment

3.1 Placing an Order

When you place an order through our website or by telephone, you are making an offer to purchase the Goods in accordance with these Terms and Conditions.

After submitting your order, you will receive an acknowledgement by email confirming that we have received your order. This acknowledgement is for information only and does not constitute acceptance of your order.

All orders are subject to acceptance by us.

3.2 Formation of the Contract

A legally binding Contract between you and us is formed only when we dispatch the Goods and send you a dispatch confirmation email.

Until that time, we reserve the right to decline or cancel your order without liability where permitted by law.

If we are unable to accept your order, we will notify you as soon as reasonably practicable and refund any payment received.

3.3 Reasons We May Decline an Order

We reserve the right to refuse or cancel an order before dispatch where reasonably necessary, including (but not limited to) the following circumstances:

the Goods are unavailable or discontinued

an obvious pricing or product description error has occurred

payment cannot be authorised

we reasonably suspect fraudulent or unlawful activity

delivery restrictions prevent us from supplying the Goods

the order appears to have been placed for commercial resale where these Terms apply only to Consumers

the order breaches these Terms or any promotional conditions

circumstances arise outside our reasonable control which prevent us from fulfilling the order.

If your order is cancelled before dispatch, any payment already taken will be refunded using your original payment method.

3.4 Prices

All prices displayed on our website include UK Value Added Tax (VAT) at the prevailing rate unless otherwise stated.

Delivery charges are shown separately during checkout before you confirm your order.

Although every effort is made to ensure prices are accurate, pricing errors may occasionally occur.

If we discover an obvious pricing error before dispatch, we may contact you to confirm whether you wish to proceed at the correct price or cancel your order. If we are unable to contact you, we may cancel the order and issue a full refund.

3.5 Payment

Payment must be made in full before Goods are dispatched unless we have expressly agreed otherwise in writing.

We accept the payment methods displayed during checkout, which may include major debit cards, credit cards, PayPal, Klarna, approved finance services and bank transfer. The availability and terms of third-party payment or finance services are determined by the relevant provider.

Payment processing is carried out securely through our authorised payment service providers. We do not store your full payment card details.

3.6 Payment Verification and Fraud Prevention

To help protect our customers and prevent fraudulent transactions, we may carry out reasonable verification checks before dispatching an order.

These checks may include:

verification of billing and delivery addresses

confirmation of payment details

identity verification where appropriate

additional security checks requested by our payment providers.

Where additional verification is required, dispatch may be delayed until the checks have been completed.

If we reasonably believe that an order is fraudulent or unauthorised, we reserve the right to cancel the order and refund any payment received.

3.7 Product Availability

All Goods are offered subject to availability.

Occasionally stock levels shown on our website may not accurately reflect current availability due to simultaneous sales, supplier shortages or stock discrepancies.

Where Goods become unavailable after an order has been placed, we will contact you to offer one of the following options:

a full refund

an alternative product (where available)

waiting for new stock to arrive

cancelling the affected item whilst proceeding with the remainder of the order, where practical.

3.8 Promotional Offers and Discount Codes

From time to time we may offer promotional discounts, voucher codes or special offers.

Unless expressly stated otherwise:

only one promotional code may be used per order;
promotional codes cannot be exchanged for cash;
promotional codes cannot be applied retrospectively;
promotional codes cannot be combined with any other offer unless stated;
promotional offers remain subject to product availability.
We reserve the right to amend or withdraw promotional offers at any time where reasonably necessary, including where an obvious pricing or technical error has occurred.

3.9 Quantity Restrictions

Goods sold through our consumer website are intended for personal use.

We reserve the right to limit quantities purchased by any individual customer where we reasonably believe purchases are intended for resale or commercial distribution.

4. Delivery, Collection, Risk and Ownership

4.1 Delivery Areas

We deliver to addresses within the United Kingdom only. Delivery availability, charges and service levels may vary by postcode, product type, size, weight and courier restrictions.

Additional delivery charges or restrictions may apply to remote or offshore locations, including the Scottish Highlands and Islands, Northern Ireland, the Isle of Man, the Isle of Wight and the Channel Islands. Any applicable charge or restriction will be shown at checkout or advised before dispatch.

Some products, including lithium-ion batteries, chemicals and other goods classified as dangerous goods for transport, may be subject to additional courier restrictions or extended delivery times.

4.2 Delivery Times

Our standard delivery service normally takes 3-5 Working Days. Where Next Day Delivery is available, Orders must generally be placed and payment successfully completed before 2:00pm on a Working Day. Orders placed after the cut-off, at weekends or on public holidays will be processed on the next Working Day.

Our advertised free-delivery thresholds are currently:

Free Standard Delivery on qualifying Orders over £150

Free Next Day Delivery on qualifying Orders over £250; and

Free Saturday Delivery on qualifying Orders over £300.

Thresholds, qualifying products, excluded postcodes and service availability may change and will be confirmed at checkout. Oversized, heavy, hazardous or restricted Goods may be excluded or subject to an additional charge.

Any delivery dates or times quoted by us are estimates unless we expressly agree a guaranteed date in writing. While we make every reasonable effort to deliver within the estimated timescale, delays may occur due to circumstances outside our reasonable control. Nothing in this section affects your statutory rights where we fail to deliver within an agreed timescale.

4.3 Delivery Address

It is your responsibility to ensure that the delivery address and contact details supplied when placing your order are complete and accurate.

If you become aware of an error after placing your order, please contact us immediately.

Where your order has not yet been dispatched, we will make reasonable efforts to amend the delivery details.

Once an order has been dispatched, we may be unable to change the delivery address.

Where additional delivery charges are incurred as a result of incorrect information supplied by you, these costs may be payable by you.

4.4 Delivery Attempts

Deliveries requiring a signature should be accepted by you or by a person authorised by you at the delivery address.

If delivery cannot be completed because:

no one is available to accept delivery;
the delivery is refused without good reason;
collection from the carrier is not made within the required timescale; or
incorrect delivery information has been supplied,
the carrier may return the Goods to us.
Where this occurs, we may charge the reasonable costs incurred for any re-delivery or return carriage before the Goods are dispatched again.

4.5 Inspection of Goods

We recommend that you inspect your Goods as soon as reasonably practicable after delivery.

If the packaging appears visibly damaged, you should note this when accepting delivery where possible.

Failure to record visible damage with the courier will not affect your statutory rights.

If Goods arrive damaged, incomplete or incorrect, please notify us as soon as reasonably possible so that we can investigate and resolve the issue promptly.

4.6 Delivery of Multiple Items

Where your order contains multiple products, we may deliver them separately.

You will not be charged additional delivery costs where we decide to split deliveries.

4.7 Click & Collect and Trade Counter Collection

Click & Collect is available for eligible Goods from our trade counter, subject to stock availability and confirmation that your Order is ready. Please do not travel to collect until we have notified you that the Order is available.

Suitable proof of identity, the payment card used where requested, and the Order confirmation may be required before Goods are released. Where another person is collecting on your behalf, we may require prior authorisation and identification.

Risk passes to you once the Goods have been handed to you or your nominated representative. We reserve the right to refuse collection where satisfactory identification or authorisation cannot be provided.

4.8 Passing of Risk

The Goods become your responsibility from the time that you, or a person nominated by you, takes physical possession of them.

If you arrange your own carrier to collect Goods from us, responsibility passes to you once the Goods have been handed to that carrier.

4.9 Ownership of Goods

Ownership of the Goods remains with us until payment has been received in full.

Once payment has been received in full, ownership transfers to you.

4.10 Failed or Undeliverable Deliveries

If Goods are returned to us because:

the delivery address was incorrect

delivery was repeatedly unsuccessful

the Goods were refused without lawful reason

the Goods were not collected from the carrier within the required period,

we will contact you to arrange re-delivery.

Any additional delivery costs reasonably incurred may be payable before re-dispatch.

If we are unable to contact you after making reasonable attempts, we reserve the right to cancel the Contract and refund the purchase price, less any reasonable costs incurred in returning or re-delivering the Goods, where permitted by law.

4.11 Delivery Delays Beyond Our Control

We shall not be responsible for delays caused by circumstances outside our reasonable control, including but not limited to:

severe weather

road traffic incidents

industrial action

courier network disruption

customs or border delays

supplier delays

shortages of raw materials

government restrictions

cyber incidents affecting logistics providers

other events outside our reasonable control.

Where such delays occur, we will use reasonable endeavours to minimise disruption and keep you informed.

4.12 Commercial Resale

Goods purchased through our consumer sales channels are supplied for personal use only.

We reserve the right to refuse delivery or cancel orders where we reasonably believe that Goods are being purchased for commercial resale, unauthorised distribution or drop-shipping.

5. Your Right to Cancel, Returns and Refunds

5.1 Your Right to Cancel and Our 30-Day Returns Policy

If you purchase Goods from us as a Consumer through our Website or by telephone, you normally have the statutory right to cancel the Contract without giving a reason within 14 calendar days after the day you receive the Goods, or, where Goods are delivered separately, the day you receive the final item.

In addition to your statutory rights, Monkey Tools offers a 30-day returns period for most unwanted Goods, beginning on the day you receive them. Returns made after the statutory cancellation period but within our 30-day policy are subject to the Goods being unused, complete and in a resaleable condition, with all accessories, manuals and packaging included where reasonably possible.

Our additional 30-day policy does not reduce or replace your statutory rights.

5.2 How to Cancel

To exercise your right to cancel, you must notify us before the cancellation period expires.

You may do this by:

emailing our Customer Services team

writing to us at our registered address

contacting us through our website; or

telephoning our Customer Services team.

Your cancellation notice should clearly state:

your name

your order number

the Goods you wish to cancel; and

your decision to cancel the Contract.

You may use the model cancellation form available on our website, although you are not required to do so.

5.3 Returning Cancelled Goods

Once you have informed us that you wish to cancel your Contract, you must return the Goods to us without undue delay and, in any event, within 14 days of notifying us.

Unless the Goods are faulty, damaged, incorrectly supplied, or we have agreed otherwise, you are responsible for arranging and paying the direct cost of returning unwanted Goods. If you ask us to arrange a courier collection, the collection charge will be confirmed in advance and may be deducted from your refund where permitted by law.

Where Goods are too large, too heavy or unsuitable for normal postal services, we can arrange collection using our nominated carrier. The cost of collection will be advised in advance and deducted from your refund only where permitted by law or charged separately if agreed.

We recommend using a tracked and appropriately insured delivery service, as you remain responsible for the Goods until they are received by us.

5.4 Condition of Returned Goods

You are entitled to inspect and handle Goods to the extent reasonably necessary to establish their nature, characteristics and functioning, in the same way that you would be permitted to do in a retail shop.

You should take reasonable care of the Goods while they are in your possession.

If the Goods have been handled beyond what is reasonably necessary, resulting in a reduction in their value, we may make a reasonable deduction from your refund to reflect that loss in value.

Examples of handling that may result in a deduction include (without limitation):

prolonged or excessive use

damage caused during assembly or operation

missing components or accessories

damage caused by inadequate packaging during return

writing on or damage to the manufacturer's packaging beyond what is reasonably necessary for inspection.

The existence of opened packaging alone will not automatically result in a deduction.

5.5 Refunds Following Cancellation

If you cancel your Contract in accordance with these Terms, we will refund:

the purchase price of the Goods; and

the cost of our standard outbound delivery service.

If you selected a premium or enhanced delivery option, we are only required to refund the cost of our standard delivery service.

Refunds will be made without undue delay and no later than:

14 days after we receive the returned Goods; or

14 days after you provide satisfactory evidence that the Goods have been returned, whichever is earlier.

Refunds will normally be made using the same payment method used for the original purchase unless you agree otherwise.

We will not charge any fee for processing your refund.

5.6 Goods Excluded from Cancellation Rights

Your statutory cancellation rights do not apply to Goods that are exempt under the Consumer Contracts Regulations, including (where applicable):

Goods made to your own specification or clearly personalised;
sealed Goods that are not suitable for return for health protection or hygiene reasons once unsealed, including socks and hygiene or personal protective equipment where the hygiene seal or packaging has been opened;
sealed software or digital media once unsealed;
other Goods where an exemption applies under applicable consumer legislation.
This section does not affect your rights where Goods are faulty or not as described.

5.7 Returns Between 15 and 30 Days

Where an unwanted return is made after the statutory 14-day cancellation period but within our 30-day returns period, acceptance is subject to the Goods being unused, complete and in a resaleable condition, with all original accessories, manuals and packaging included where reasonably possible.

We may refuse a discretionary return, or make a reasonable deduction to reflect any reduction in value, where the Goods have been used, damaged, are incomplete or cannot reasonably be resold as new. This does not apply where Goods are faulty or where you have other statutory rights.

5.8 Incorrectly Ordered Goods

If you accidentally order the wrong product, please contact us as soon as possible.

If your Order has not yet been dispatched, we will make reasonable efforts to amend or cancel it.

If the Goods have already been dispatched, you may still exercise your statutory cancellation rights in accordance with this Section.

5.9 Faulty, Damaged or Incorrect Goods

Nothing in this Section affects your legal rights where Goods:

are faulty

arrive damaged

are not as described

are not of satisfactory quality; or

are not fit for their intended purpose.

Where Goods are faulty, damaged or supplied incorrectly, please contact us as soon as reasonably possible.

We will investigate the issue and, where appropriate, arrange repair, replacement, collection or refund in accordance with your statutory rights.

You may, if you prefer, choose to use the manufacturer's authorised repair network where available, but you are not required to do so.

Your Contract remains with Monkey Tools.

5.10 Inspection of Returned Goods

Returned Goods may be inspected upon receipt to determine whether:

they are faulty;
they have been used beyond reasonable inspection;
damage has resulted from misuse, accidental damage or normal wear and tear.
Where independent manufacturer inspection confirms that damage has resulted from misuse, accidental damage, neglect, unauthorised modification or failure to follow operating instructions, we may decline the claim or offer a chargeable repair.

Where no manufacturing fault is found, we may ask you to pay the reasonable cost of returning the Goods to you.

5.11 Return Address

Please include your order number and contact details with all returns to help us process your return as quickly as possible.

6. Faulty Goods, Repairs and Manufacturer's Guarantees

6.1 Your Statutory Rights

Your statutory rights are provided by the Consumer Rights Act 2015 and are not affected by any manufacturer's guarantee or by these Terms and Conditions.

If the Goods supplied are:

not of satisfactory quality

not fit for their intended purpose; or

not as described,

you may be entitled to a repair, replacement, price reduction or refund depending on the circumstances and the time elapsed since delivery.

6.2 Reporting a Fault

If you believe your Goods are faulty, please contact our Customer Services team as soon as reasonably practicable.

To help us assess the issue, we may ask you to provide:

your order number

the product model and serial number (where applicable)

a description of the fault

photographs or videos demonstrating the issue

confirmation of when the fault first occurred.

Providing this information often enables us to resolve problems more quickly without requiring the Goods to be returned.

6.3 Troubleshooting

Before arranging a return, repair or replacement, we may ask you to carry out reasonable troubleshooting steps.

This may include:

checking batteries or chargers

confirming compatible accessories are being used

resetting electronic equipment

following manufacturer diagnostic procedures.

These requests are intended to help identify simple faults and reduce unnecessary delays.

6.4 Manufacturer Authorised Repair Networks

Many manufacturers operate authorised service centres throughout the United Kingdom.

Manufacturer warranty claims are normally administered directly between you and the manufacturer or its authorised repair network, and we may provide the information needed to begin that process. This does not affect your statutory rights against Monkey Tools Ltd as the retailer.

6.5 Collection and Inspection

Where inspection of the Goods is necessary, we may:

arrange collection

provide instructions for returning the Goods

ask you to deliver the Goods to an authorised repair centre.

Returned Goods may be inspected by us or by the manufacturer to determine the cause of the reported fault.

Reasonable testing may be carried out before any remedy is agreed.

6.6 No Fault Found

If inspection confirms that:

no manufacturing fault exists

the Goods are operating correctly

the reported issue results from incorrect operation

the issue is caused by incompatible accessories or consumables,

we will explain the findings to you.

Where appropriate, we may return the Goods to you and reserve the right to charge reasonable carriage costs where this has been made clear in advance.

No inspection or carriage charge will be applied where your statutory rights require us to bear those costs.

6.7 Misuse, Accidental Damage and Unauthorised Repairs

Manufacturer's guarantees and statutory remedies do not normally cover faults resulting from:

misuse

accidental damage

improper installation

failure to follow operating instructions

use outside the manufacturer's intended purpose

commercial use where the manufacturer excludes such use

fair wear and tear

water ingress where the product is not designed for such use

use with incompatible batteries, chargers or accessories

unauthorised modifications or repairs.

Where inspection confirms that damage has occurred for one of these reasons, we may offer a chargeable repair where available.

6.8 Repairs

Where repair is the appropriate remedy, repairs may be carried out:

by the manufacturer

by an authorised service agent; or

by another suitably qualified repair provider.

We will use reasonable endeavours to ensure repairs are completed within a reasonable period.

Repair times may vary depending upon:

availability of replacement parts

manufacturer lead times

the complexity of the repair

seasonal demand.

6.9 Replacement Goods

Where replacement is the appropriate remedy, we may supply:

the same model

an equivalent model of equal or higher specification where the original product has been discontinued; or

another remedy available under consumer legislation.

6.10 Manufacturer's Guarantee

Many products are supplied with a manufacturer's guarantee.

Unless stated otherwise, products are generally supplied with a one-year manufacturer guarantee. The exact duration and terms of any guarantee are determined by the manufacturer.

Some manufacturers offer an extended guarantee, commonly up to three years, where the product is registered within the manufacturer's specified period after purchase.

It is your responsibility to complete any registration required by the manufacturer.

Failure to register a product where required may affect the manufacturer's guarantee but will not affect your statutory rights.

6.11 Consumable Items

Unless faulty upon delivery, consumable items are not generally covered against normal wear through use.

Examples include:

drill bits

saw blades

sanding abrasives

router cutters

batteries reaching the end of their normal service life

carbon brushes

belts

polishing pads.

Normal deterioration through use does not constitute a manufacturing fault.

6.12 Batteries and Chargers

Rechargeable batteries are consumable products with a finite operating life.

Gradual reduction in battery performance over time, through normal use and charging cycles, is expected and does not of itself indicate a manufacturing fault.

Battery performance may also be affected by:

storage conditions

operating temperature

charging practices

frequency of use.

Any manufacturing defect will be dealt with in accordance with the manufacturer's warranty and your statutory rights.

6.13 Product Safety

You should immediately stop using any product that you believe may be unsafe.

If you believe a product presents a safety risk, please contact us before attempting any repair or continued use.

Where a manufacturer issues a safety notice or product recall, we will cooperate fully with the manufacturer to assist affected customers.

6.14 Limitation of Manufacturer's Guarantees

Manufacturer's guarantees are provided by the manufacturer and are separate from your Contract with Monkey Tools.

We are not responsible for the content, duration or administration of any manufacturer's guarantee.

Nothing in this section excludes or limits any rights you have against us under applicable consumer protection legislation.

7. Product Information, Compatibility and Safe Use

7.1 Product Descriptions

We make every reasonable effort to ensure that product descriptions, technical specifications, dimensions, images and other information published on our website are accurate at the time of publication.

However, manufacturers may change product specifications, packaging, accessories or appearance without prior notice.

Such changes will not constitute a defect provided the Goods continue to perform their intended function and remain substantially as described.

7.2 Product Images

Images shown on our website are provided for illustrative purposes only.

Whilst we endeavour to display products as accurately as possible, colours, finishes and packaging may vary depending upon:

manufacturer updates

screen or monitor settings

lighting conditions during photography.

Images do not form part of the Contract unless specifically stated.

7.3 Technical Specifications

Product specifications are supplied by manufacturers and are believed to be accurate at the time of publication.

Specifications may change without notice as part of manufacturers' ongoing product development programmes.

Where a specification is materially altered before dispatch, and the change is likely to affect your purchasing decision, we will endeavour to notify you where reasonably practicable.

7.4 Product Availability

Manufacturers occasionally discontinue products or replace them with updated models.

Where a product becomes unavailable before dispatch, we may offer:

a full refund

an alternative product of equivalent specification

the opportunity to wait for replenishment.

Any substitute product will only be supplied with your agreement.

7.5 Compatibility

It is your responsibility to ensure that any accessories, consumables or replacement parts purchased are compatible with your existing equipment unless compatibility advice has been specifically provided by us.

Examples include (without limitation):

batteries

chargers

guide rails

router accessories

blades

sanding abrasives

dust extraction fittings

hose adaptors

drill chucks

collets

sockets

polishing accessories.

If you are unsure about compatibility before placing your order, we encourage you to contact our Customer Services team for advice.

Where compatibility advice has been provided by us and is subsequently found to be incorrect, this will not affect your statutory rights.

7.6 Professional Advice

Information published on our website, in catalogues or provided by our Customer Services team is intended as general product guidance only.

It should not be relied upon as professional engineering, electrical or health and safety advice.

Where specialist advice is required, you should consult an appropriately qualified professional before using the Goods.

7.7 Safe Use of Products

Power tools and associated equipment should always be used:

in accordance with the manufacturer's instructions

with appropriate personal protective equipment (PPE)

for their intended purpose

by persons competent to operate them safely.

Failure to follow the manufacturer's operating instructions may:

affect product performance

invalidate any manufacturer's guarantee

increase the risk of injury.

7.8 Electrical Products

Electrical products should only be connected to suitable power supplies and used in accordance with the manufacturer's operating instructions.

Where products require assembly, installation or electrical connection, these should be carried out safely and, where appropriate, by a suitably qualified person.

Nothing in these Terms limits your statutory rights in relation to faulty electrical products.

7.9 Batteries and Chargers

Rechargeable batteries and chargers should only be used with compatible products recommended by the manufacturer.

The use of counterfeit, modified or incompatible batteries or chargers may:

damage the product

reduce performance

invalidate the manufacturer's guarantee

present a safety risk.

We cannot accept responsibility for damage caused by the use of incompatible or unauthorised accessories.

This does not affect your statutory rights where the Goods themselves are faulty.

7.10 Firmware and Smart Products

Some products may contain software or firmware that can be updated by the manufacturer.

Where software updates are recommended by the manufacturer to maintain performance or security, you should follow the manufacturer's guidance.
